Even after the correction of mistake on Monday, Samsung is still required to pay Apple Inc. (NASDAQ:AAPL) $119.5 million in damages. The correction, however, implies that the trial is considered over and only the appeals are pending. Apple has been asking for $2.2 billion to be paid in damages, but this amount has not been approved by the jury.
Jury corrects verdict form, but no benefit to Apple
In its initial verdict late Friday, the jury cleared Samsung of infringing the two patents and awarded damages to Apple Inc. (NASDAQ:AAPL) for a third patent for the infringement of which Samsung was already found guilty. Samsung was awarded $158,400 as damages to be paid by Apple for the infringement of one patent of Samsung.
An error was made by the jury in the verdict form and they noticed it on Friday itself. They had not allocated any damages to Apple on account of the infringement of a patent of Apple Inc. (NASDAQ:AAPL) by a Samsung product. This error was then corrected by the jury at the District Court in San Jose, California on Monday and it took almost two hours for the jury to finish the work.
No additional damages awarded to Apple
The Samsung product that was responsible for the infringement of the Apple patent was overlooked by the jury and a penalty of $4 million was imposed on Samsung to be paid to Apple Inc. (NASDAQ:AAPL). The new amount awarded as damages by Samsung was not an addition to the original damages amount, but was adjusted from the amounts payable as damages on account of other infringements. This way all the infringements of Apple by Samsung were covered by the jury in its revised verdict, but no change was there in the total damages payable by Samsung to Apple and it remained at $119.5 million as per the reporters present in the courtroom, at the time of verdict revision.
Apple Inc. (NASDAQ:AAPL) was anticipating that after the consideration of the overlooked product by the jury, they may be paid damages that are higher than those in the initial verdict. This verdict, however, was not as per Apple’s expectations and they are extremely dismayed by this. However, this verdict is in favor of both Samsung and Google, who had agreed to cover a part of the costs that Samsung will have to bear post trial.
