A Seoul court ruled in favor of Apple Inc. (NASDAQ:AAPL) saying that the iPhone maker has not infringed three of the Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930)’s patent. Samsung alleged that iPhone and iPad models desecrated three of its patents, but failed to prove the claim.
Samsung patented technology easy to develop
Judge Shim Woo-Yong ruled that the two of the technology used by Samsung in the patent could be developed independently by other companies, and one of the patents was not used in the iPad.
“We are glad the Korean court joined others around the world in standing up for real innovation and rejecting Samsung’s ridiculous claims,” Apple spokesman Steve Park said.
Samsung dragged Apple Inc. (NASDAQ:AAPL) in court over the patents, in March 2012, and claimed that the iPhone maker has infringed the patented technology related to short message services, in smartphones and tablets.
In compensation, the South Korean company demanded 100 million won, and a ban on sales of six iPhone and iPad models inclusive of the iPhone and iPad models, which are still selling in the market.
Patents in question
According to judge, the technology in which the message does not disappear completely once the user switches to a new application could be developed by the independent technology companies, and so the Samsung patent is not infringed. The judge added that the other technology patented by Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) is reading the message by touching the notification box is easy to develop, and so it is not the violation of the patents.
As per the judge, the third technology was not at all used by Apple. The third patent of Samsung relates to how the smartphone shows the messages send by the same individual together. For messaging services iMessage is used, in Apple.
Loss again for Samsung
Apple Inc. (NASDAQ:AAPL) and South Korean electronics giant Samsung have been in continuous tussle over patents related to smartphones and tablets. Samsung’s latest defeat would weigh heavily on the Galaxy maker as the Korean company is already under pressure to pay $930 million from two court rulings. Samsung is looking forward to appeal in both cases.
Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) expressed its dissatisfaction over the ruling and said that it would consider an appeal further after going through the all the aspects. Samsung has lost more legal battles compared to Apple, till now. A month ago Samsung was ordered to pay $290 million to Apple.
